Recent Developments in Artificial Intelligence Law


  1. United Nations General Assembly Resolution on Artificial Intelligence

The United Nations General Assembly recently adopted a draft resolution on the promotion of “safe, secure, and trustworthy” Artificial Intelligence systems, supported by more than 120 UN member states as “co-sponsors”. The  resolution emphasizes the protection and promotion of human rights in the development and use of artificial intelligence. The resolution underscores several key points, including the necessity of fostering collaboration among all relevant actors -such as member states, local and international organizations, civil society groups, and the media- to promote reliable and secure AI systems. It also calls on member states to encourage the inclusion of developing countries in processes related to AI use and to ensure that these countries benefit from trustworthy AI technologies. Additionally, the resolution highlights the importance of raising awareness around the use of AI systems, promoting transparency and predictability in AI operations, and advancing mechanisms for both physical and data  security.

  1. The Italian Data Protection Authority, Garante, Imposed An Administrative Fine of €50,000 on A Public Authority Due to A Personal Data Breach Arising From The Use of Artificial Intelligence.

Garante, the Italian Data Protection Authority, imposed an administrative fine on the Municipality of Trento on the grounds that two artificial intelligence projects –“Marvel” and “Protector”- which collected data through cameras and microphones in public spaces violated personal data processing requirements. The authority also ordered the deletion of the collected data. In response, the Municipality issued an information note outlining the purposes and benefits of these projects, claiming that the personal data recorded by cameras and microphones had been anonymized through AI algorithms at the point of collection. However, Garante found that the anonymization techniques employed on the “Marvel” and “Protector” platforms were insufficient and determined that the Municipality had acted in violation of the principle of “lawfulness, fairness, and transparency” in the processing and sharing of data. As a result of these violations, the Municipality of Trento was fined €50,000, and the processing of personal data already collected under the “Marvel” and “Protector” projects was prohibited, with an order for the deletion of such data.

  1. European Union Announces Decision to Establish An Artificial Intelligence Office

The European Union Commission has announced the establishment of the European Artificial Intelligence Office, which will oversee the implementation of the Artificial Intelligence Act -a regulation set to come into force in the near future with the aim of promoting and governing the use of AI. According to the decision, the European AI Office will be responsible for ensuring uniform application of the AI  Act across the European Union. It will also undertake critical tasks such as conducting assessments and preparing detailed reports in line with the provisions of the Act and contributing to the implementation of relevant international rules and principles.

  1. The Organization for Economic Co-operation and Development (OECD) Published an Article on the Issues of Artificial Intelligence Data Scraping.

The published article defines data scraping as the use of crawlers and other tools to obtain data from social media or third-party websites. The negative aspects of data scraping, such as the unlawful use of personal data, violation of copyright, and deception of individuals through misinformation, lead to violations affecting various legal disciplines, including Personal Data Protection, Competition Law, and Intellectual Property Law. The article discusses regulations on artificial intelligence and data scraping, as well as current disputes, and emphasizes that solving the artificial intelligence data scraping problem requires the coming together of a large community.

  1. The New York State Bar Association's Artificial Intelligence Task Force Published a Report Containing Its Review and Recommendations on Artificial Intelligence.

The report examines the impact of artificial intelligence on the legal field and presents several recommendations. The recommendation in the report include:

  • Adoption of the guiding principles outlined in the report,
  • Prioritizing both legislation and education,
  • Training judges, lawyers, law students, and lawmakers to understand the technology and apply existing laws to regulate it,
  • Legislators and lawmakers identifying technology-related risks not addressed by current laws.

The report also analyzes the benefits and risks of artificial intelligence and generative AI, as well as their impact on the legal profession.
